
Professional officers are required
to submit a performance evaluation report in all cases where
the performance or conduct of the assigned counsel/solicitor
is considered unsatisfactory.
Where there is prima facie case of unsatisfactory performance/conduct,
the assigned counsel/solicitor in question will be invited
to give a written explanation of his unsatisfactory performance/conduct
within 14 days. Where the written explanation provided by
the assigned counsel/solicitor is considered not acceptable,
the matter will be referred to the Departmental Monitoring
Committee for advice. Before including his or her name on
the Record of Unsatisfactory Performance/Conduct; or in sufficiently
serious cases, before his or her name is removed from the
Legal Aid Panel, the assigned counsel/solicitor concerned
will be given a notice of intention and an opportunity to
make representations. No decision will be made by the Director
in this regard without consulting the Departmental Monitoring
Committee which comprises a representative from the Independent
Commission Against Corruption.
