Flow Chart on Processing Applications for Access to Information

1. Application received and registered by Access Clerk
2. Initial Screening by AIO ¡÷ Information held by another bureau/department (B/D) ¡÷ Refer the request to the B/D concerned and notify applicant
3. Subject officer (SO) to process the application
4. AIO/SO to seek clarification from applicant if necessary
5.
a. Information available and not within Part 2 of the Code ¡÷ SO to prepare the information and draft reply
b. Personal information ¡÷ SO to make sure that the information does not interfere with the privacy of an individual in accordance with para 2.15 of the Code. Reference should also be made to the requirements of the Personal Data (Privacy) Ordinance and the confidentiality provision in Section 24, in particular sub-section (4) of the Legal Aid Ordinance ¡÷ SO to prepare the information and draft reply
c. Information within Part 2 of the Code ¡÷ SO to make recommendation to subject division/section head for decision ¡÷ SO to draft reply
d. Third party Information ¡÷ Seek third party's view/consent on release of requested information ¡÷ SO to submit minute to subject division/unit head for decision with third party's view/consent. SO to seek legal advice if necessary ¡÷ Section/unit head's decision on release of third party information ¡÷ SO to draft reply
